Comelec to appeal SC ruling on ‘second placer rule’

THE Commission on Elections (Comelec) yesterday said it is considering filing a motion for reconsideration on the Supreme Court (SC) ruling abandoning the “second placer rule.”

In a short statement, Comelec chairman George Garcia said they will withhold comment on the decision and instead focus on appealing their case.

“Since the decision is not yet final, we will reserve, in the meantime, our comment. But we are now studying the possibility of filing an MR,” he said.

In a decision released on Friday, the SC said it is abandoning the “second placer rule” as there is no legal basis for its implementation. Instead, the SC said the rules on succession under the Local Government Code shall apply in all cases, where a permanent vacancy results from a local elective official’s disqualification from office.
