SC rules resolution of homeowners’ disputes under HLURB

The Supreme Court en banc has ruled that disputes among and between members of homeowners’ associations are within the purview of the Housing and Land Use Regulatory Board (HLURB) and not regional trial courts.

This was contained in a September 14, 2021 ruling of the High Court where it junked the petition of lawyer Pablo Francisco questioning the 2017 decision of the Court of Appeals which nullified an RTC order that acted on the criminal case he filed against Sandra Bernales and Melanio Del Castillo.

Francisco, Bernales and Del Castillo are all officers of the Brookside Residents Association in Antipolo City.

Court records showed that Francisco sued Bernales and Del Castillo before the Antipolo city regional trial court after they turned down his request to check the financial records of the homeowners’ association from 2008 to 2013.

Francisco sued the two for violation of Republic Act 9904 or the Magna Carta for Homeowners Associations.
