THE Supreme Court (SC) has dealt another blow to Makati City’s bid to retain control over the 729-hectare Fort Bonifacio Military Reservation, including the Bonifacio Global City, as it rejected its plea to appeal for a second time its decision declaring giving Taguig City jurisdiction over the contested area.
In a resolution dated June 26, 2023 but only made public Thursday, the High Court’s Special Third Division denied Makati’s second omnibus motion which, among others, sought the Court’s leave to file and admit its second motion for reconsideration, which is actually considered a “prohibited pleading under the Rules of Court.”
Consequently, the SC noted without action the Makati City government’s second motion for reconsideration assailing the Court’s decision dated December 1, 2021.
In the same resolution, the SC also noted without action the Taguig’s City’s manifestation with motion, which prayed that Makati City and Mayor Abigail Binay be required to show cause why they should not be sanctioned for making certain claims in relation to the present case.
The SC has yet to release a full copy of its decision.
To recall, Taguig City Mayor Lani Cayetano formally asked the High Court to order Makati City and Binay to explain her “troubling claim” in media interviews that they received an order from the High Court setting the case for hearing and oral arguments.
Cayetano said that no order or resolution has been issued upon their verification with the SC’s Third Division.
SC spokesperson Brian Keith Hosaka has also denied that oral arguments on the case have been scheduled.
