Poll chief urges Guo to file counter-affidavit

THE Commission on Elections (Comelec) is urging dismissed Bamban mayor Alice Guo to file her counter-affidavit in the material misrepresentation complaint filed against her concerning her Certificate of Candidacy (COC) for the May 2022 national and local polls.

Comelec chief George Garcia urged Guo’s camp to file her COC with the extended deadline lapsing yesterday, Monday.

“It would be unfortunate if this is resolved without the answer from the respondent,” said Garcia.

“We hope she will reconsider if she opts not to file since this is a criminal case that carries a penalty of one to six years imprisonment and perpetual disqualification to hold public office,” he added.

“We will not wait forever. If she really won’t file her counter-affidavit, we will follow our mandate and our Law Department will push forward with the case,” said Garcia.

A material misrepresentation complaint was filed motu proprio by the Comelec against Guo concerning her Certificate of Candidacy filed in the May 2022 polls.

Last August 13, the Comelec Law Department served the subpoena for Guo in the Office of the Mayor of Bamban, while directing her to personally file her counter-affidavit within 10 days or else be deemed as having waived her right to present her defense.

Last August 22, the camp of Guo asked for an extension of 10 days or until September 1 to file her counter-affidavit.
