Palace extends tenure of OICs until December

Malacañang has extended the tenures of officers-in-charge (OICs) of various government departments, agencies, bureaus, and offices until December 31 or until a permanent head is named by President Marcos Jr.

Press Secretary Trixie Cruz-Angeles said Executive Secretary Victor Rodriguez, by authority of the President, signed Memorandum Circular 3 (MC3) on July 27 extending the authority of OICs from July 31 to December 31, 2022 pending the appointment of a permanent replacement.

MC3 also extends the terms of office of non-career executive officials (CESOs) and contractual/casual employees until the end of the year or unless a permanent replacement is appointed.

It supplements MC1, which set the holdover capacities of the officials and personnel only until July 31, 2022.

Rodriguez said there is a need to extend the tenures of the OICs to ensure the continuous and effective delivery of government services.

He added that “there is a need to supplement MC No. 1 in order to ensure that no new contract, project, or disbursement of extraordinary funds is made by a department, agency, bureau, and office until the appointment is made by the President.”

Aside from extending the tenures of the OICs, MC3 states that except for those involved in the food, transportation and energy sectors, officers-in-charge are prohibited from forging new contracts and projects and disbursing extraordinary funds.

The prohibition also covers temporary heads of GOCCs, government instrumentalities with corporate powers, government corporate entities, and government financial institutions, as well as free port and special economic zone authorities.

Press Secretary Trixie Cruz-Angeles said the memorandum takes effect immediately.
