EMPLOYEES who were dismissed because of the supposed “no vaccine, no work” policy are being urged by the Department of Labor and Employment (DOLE) to file complaints against their employers.
In an online public briefing, Labor Undersecretary Benjo Benavidez said even suspended employees can file complaints with DOLE against their company implementing the discriminatory policy.
“If they are dismissed or suspended because they aren’t vaccinated, they can file appropriate complaints of illegal termination or illegal suspension,” said Benavidez, adding they are entitled to salaries despite being unable to go to work.
“If they aren’t allowed to go to work because they aren’t vaccinated, their salaries should remain the same,” said Benavidez.
He issued the statement on the heels of continued reports of some companies implementing the “no work, no vaccine” policy.
According to Benavidez, they have yet to receive formal complaints.
“We haven’t gotten any formal complaints. What we have are reports but have no names of the companies,” he said, adding this has prompted the DOLE to investigate which companies are being referred to.
“We are doing our own fact finding for us to know which companies are these and where are they located so that we can send our inspectors,” said Benavidez.
