MMDA enforces NCAP on major roads starting today

THE Metropolitan Manila Development Authority (MMDA) will start enforcing today, Monday, the No Contact Apprehension Policy (NCAP) on major thoroughfares, circumferential and radial roads under its jurisdiction in the metropolis.

The roads where the policy will be observed are C4- EDSA, C1-Recto, C2-Mendoza, Pres. Quirino Ave., C3-Araneta, C5-C. P. Garcia, Katipunan Ave., Tandang Sora, R1-Roxas Boulevard, R2-Taft Ave., R3-South Superhighway, R4-Shaw Boulevard, R5-Ortigas Ave., R6-Magsaysay Boulevard, Aurora Boulevard, R7-Quezon Ave., Commonwealth Ave., R8-A.Bonifacio, R9-Rizal Ave., and R10-Del Pan, Marcos Highway McArthur Highway.

The NCAP is being reimplemented after the Supreme Court, last May 20, partially lifted the temporary restraining order it issued in 2022 against the policy.

The MMDA, through the Office of the Solicitor General, earlier asked the High Court to lift the injunction, citing the increasing number of traffic accidents and violations since the NCAP was halted.

MMDA chief Romando Artes said there will be no major changes in the policy they have been implementing before the injunction.

“Wala namang pagbabago. Dati naman na po naming ini-implement ‘yan. Na-TRO lang po (There will be no changes. We have been implementing that before. It was just halted by the TRO),” Artes said after the SC issued its decision.

Artes said motorists apprehended under the NCAP can contest the traffic violation with the agency.

“Maaaring i-apela ang Notice of Violation sa online filing platform ng MMDA Traffic Adjudication Division (The Notice of Violation can still be appealed at the online filing platform of the MMDA Traffic Adjudication Division),” Artes said.

“Ang platform na ito ay nagbibigay-daan sa mga nagmamaneho na magsumite ng kanilang mga apela nang hindi na kinakailangang pumunta sa opisina ng MMDA (This platform will give motorists the opportunity to submit their appeal without going personally to the MMDA office),” he added.

Artes said motorists can also appeal at the MMDA office in Pasig City from Monday to Friday.

“Kung hindi nabayaran, mapupunta sa alarm list ng LTO ang license plate number ng sasakyan (Failure to pay the fine will result to the vehicle’s license plate number being put in the LTO alarm list),” he said.

The NCAP utilizes CCTV and digital cameras to identify and apprehend traffic violators through videos and images captured of their violation.

Once a violation is detected, the concerned LGU issues traffic citation tickets and mails them directly to the vehicle’s registered owners.

Non-payment of fines within seven days means their vehicles will not be accommodated for re-registration.

Meanwhile, Move It has called on the Motorcycle Taxi Technical Working Group (MCT-TWG) to immediately stay the implementation of the April 2025 order slashing its rider allocation and formally declare that the motorcycle taxi company has the right to operate with 14,000 riders, including in Cebu and Cagayan de Oro.

The appeal was made in a supplement to its motion for reconsideration filed on May 22, in which Move It warned that continued inaction on the part of the government could result in the layoff of more than 14,000 riders and could be detrimental to thousands of commuters, particularly in the face of the scheduled rehabilitation of EDSA next month.

The six-page filing supplements the company’s April 30 motion questioning the Land Transportation Franchising and Regulatory Board (LTFRB) order that directed Move It to reduce its rider force and suspend its operations in Cebu and Cagayan de Oro.

Move It maintained that the LTFRB order was “fatally flawed for non-compliance with the constitutionally protected right to due process.”

“It is both arbitrary and unjust for the Honorable MCT-TWG to base a decision — one that effectively obliterates up to 14,000 jobs — on a single ‘hearing’ conducted solely by the Secretariat, without the presence of the Chairman, Vice Chairperson, the five (5) other members of the Honorable MCT-TWG, and, most critically, without the participation of the directly affected parties, Move It and the riders.”

Move It warned that “this also equates to more than 14,000 families which are in danger of losing a source of income and users who stand to lose another option for cost-efficient, safe and convenient transportation.”

The company also pointed out the timing of the order, noting that “ironically, the Order was released just before Labor Day, a day meant to celebrate the ordinary, hardworking Filipino.”
