THE cancellation of the registration of the Duterte Youth party-list is now final and executory.
“The Clerk of the Commission has issued an Entry of Judgment and a Certificate of Finality. That means, the decision is final as far as the Comelec is concerned,” said Comelec Chairman George Garcia in an online interview on Tuesday.
“The decision of the Comelec en banc can already be implemented,” he added.
The Comelec en banc affirmed the cancellation of the registration of the Duterte Youth party-list, which was entitled to three seats in the House of Representatives had they been proclaimed after the May 2025 polls.
Duterte Youth subsequently asked the Supreme Court (SC) to restrain the Comelec from implementing its decision to disqualify it.
Garcia, however, noted that the 30-day period within which the Comelec ruling becomes final and executory lapsed yesterday, Tuesday.
“Our rules state that when a party’s registration is canceled, it has 30 days (to appeal). We waited and saw if they (Duterte Youth) could get a temporary restraining order (TRO) within those 30 days. It seems that the SC did not issue a TRO,” said the poll chief.
With the disqualification of Duterte Youth now executory, Garcia said the Commission en banc will start deliberating on who will be proclaimed instead.
“The Comelec en banc will start discussing who should benefit from the three vacant seats that should have been for the said party-list,” said Garcia.
