DOLE issues pay rules for Ninoy Aquino Day

THE Department of Labor and Employment (DOLE) yesterday reminded private establishments of the pay rules in effect for today’s (Thursday) celebration of Ninoy Aquino Day.

In its Labor Advisory No. 11-2025, the DOLE said employers must adhere to the existing pay rules during the declared Special Non-Working Day of August 21.

If the employee does not work, the Department said the ‘no work, no pay’ principle shall apply.

This, it added, is unless there is a favorable company policy, practice, or collective bargaining agreement (CBA) granting payment on a special day.

For work done during the Special Non-Working Day, the employer shall pay the employee an additional 30 percent of the basic wage on the first eight hours of work, and an additional 30 percent of the hourly rate on said day for overtime work.

For work done during the Special Non-Working Day that also falls on the employee’s rest day, the employer shall pay the employee an additional 50 percent of the basic wage on the first eight hours of work, and an additional 30 percent of the hourly rate on said day for overtime work.

Under Proclamation No. 727 – 2024, August 21 has been declared as a Special Non-Working Day in celebration of the Ninoy Aquino Day.

In a statement, former Manila mayor Lito Atienza said: “We, as Filipinos, must never forget the relevance of August 21 in our country’s history.

“This is the date when two of the most important events in our history took place — the infamous Plaza Miranda bombing in 1971, and the murder of Sen. Ninoy Aquino in 1983.

“The Plaza Miranda bombing on August 21, 1971 started the dark period in our country’s history with the declaration of Martial Law soon after and the rise of the dictatorship. We lost our democracy, and witnessed the countless kidnappings, murders and enforced disappearances of Filipinos who dared speak out against the dictatorship.

“Exactly 12 years later, on August 21, 1983, we witnessed the murder of Senator Ninoy Aquino. On this day, millions of Filipinos were awakened from their dark slumber. They began to rise as one and fought to remove the dictatorship, leading to the bloodless People Power Revolution, where we regained our freedom and democracy.”
