Hearing resumes on DQ plea vs Guanzon as PL nominee

THE Supreme Court will resume on Tuesday its oral arguments on the petition filed by the Duterte Youth party-list group challenging the substitution of former Commission on Elections (Comelec) commissioner Ma. Rowena Guanzon as the P3PWD party-list nominee.

An advisory released by the SC Public Information Office said the oral arguments is set to start at 2 p.m.

The SC first held its oral arguments on the petition on November last year.

Last year, the High Court issued a temporary restraining order against the substitution of Guanzon as nominee of the P3PWD party-list group in the House of Representatives.

To recall, P3PWD managed to snag one seat in the House after winning in the 2022 party-list race.

However, on June 14, 2022, the original nominees of the group submitted to the Comelec their resignation and/or withdrawal from the organization. On the same day, certificates of nomination and acceptance were submitted by the group, with Guanzon as its first nominee.

The following day, the poll body granted the withdrawal of the original nominees of the P3PWD party-list and gave due course to the new list of nominees.

This prompted Duterte Youth party-list Rep. Ducielle Marie Cardema and her husband and the group’s chairman, Ronald Gian Carlo Cardema, to file a petition for certiorari, prohibition and injunction against Guanzon’s nomination.

In going to the High Court, the petitioners argued that the poll body acted with grave abuse of discretion when it approved what the petition described as the “illegal and belated” substitution of Guanzon.
