FOLLOWING the lifting of the State of Public Health Emergency due to COVID-19, the Employees’ Compensation Commission (ECC) also reinstated the 3-year prescriptive period to file Employees’ Compensation (EC) claims.
Based on ECC Board Resolution 24-01-02, the 3-year prescriptive period for all EC claims applications with the either Social Security System (SSS) or Government Service Insurance System (GSIS) has been reinstated.
“The lifting of the suspension of the 3-year prescriptive period took effect on January 18, 2024,” said the ECC.
“Claimants are again given three years from the time the cause of action accrued to file their applications for EC claims with the SSS and GSIS,” it added.
ECC said the EC claims cover any work-related contingencies, such as sickness, injury, or death.
EC claims from the private sector are filed with the SSS, while GSIS handles those from the public sector.
Under Presidential Decree No. 626, EC claimants are given three years from the time the cause of action accrued to file their applications for EC claims with the SSS and GSIS.
However, during the COVID-19 pandemic, the ECC suspended the prescriptive period pursuant to Proclamation No. 922, which declared a State of Public Health Emergency.
Last July 21, 2023, under Proclamation No. 297, the State of Public Health Emergency due to COVID-19 was lifted.
