THE Department of Labor and Employment (DOLE) yesterday issued pay rules for the Holy Week holidays from April 1 to 3.
Based on Labor Advisory No. 04-2021, private sector employees are entitled to particular wages during the regular holidays of April 1 (Maundy Thursday) and April 2 (Good Friday) as well as on the special non-working day on April 3 (Black Saturday).
For April 1 and 2, DOLE said that for work done during the regular holidays, the employee shall be paid 200 percent of his/her wage for that day for the first eight hours, and an additional 30 percent of his/her hourly rate for overtime work.
For work done during a regular holiday that also falls on his/her rest day, the worker shall be paid 230 percent of his/her basic wage for that day for the first eight hours, and an additional 30 percent of his/her hourly rate for overtime work.
If the employee did not work, he/she shall be paid 100 percent of his/her wage for that day.
As for April 3, the labor department said that for work done during the special non-working day, a worker shall be paid an additional 30 percent of his/her basic wage on the first eight hours of work, and an additional 30 percent of his/her hourly rate for overtime work.
For work done during a special non-working day that also falls on his/her rest day, the worker shall be paid an additional 50 percent of his/her basic wage on the first eight hours of work, and an additional 30 percent of his/her hourly rate for overtime work.
If the employee did not work, the “no work, no pay” principle shall apply, unless there is a favorable company policy, practice, or collective bargaining agreement granting payment on a special non-working day.
DOLE said that companies that are not operating due to the COVID-19 pandemic are exempted from the pay rules.
“In view of the existence of a national emergency arising from the COVID-19 situation, establishments that have totally closed or ceased operation during the community quarantine period are exempted from the payment of the holiday pay on April 1 and 2 under this advisory,” said DOLE.
The enhanced community quarantine (ECQ) is in effect in the National Capital Region and the provinces of Bulacan, Laguna, Rizal, and Cavite until April 4.
