ON a vote of 6-0 with one inhibition, the Commission on Elections (Comelec) yesterday junked another motion for reconsideration (MR) on a case that sought to block the presidential bid of Ferdinand “Bongbong” Marcos Jr.
It said the appeal failed to offer new arguments.
Only one MR is pending.
The Comelec en banc, in a five-page resolution dated May 11,the Comelec en banc denied the MR of Danilo Lihaylihay to have Marcos declared as a nuisance candidate in the May 2022 polls.
“It is apparent on the face of the motion that there is no cogent reason to disturb the findings of the Commission (Second Division),” said the Comelec.
“… the Commission (en banc) denies respondent’s motion for reconsideration dated 22 December 2021 and affirms the resolution of the Commission (Second Division) promulgated on 16 December 2021,” added the poll body.
The poll body said Lihaylihay’s MR is a mere rehash of his original petition.
Lihaylihay filed the disqualification petition in October 2021 and the Comelec Second Division denied it in December 2021, saying the petitioner failed to prove Marcos is a nuisance candidate. Lihaylihay then appealed the case before the Commission en banc.
Earlier this week, the Comelec en banc also denied the consolidated MR filed by Bonifacio Ilagan et. al., Akbayan Party, and Abubakar Mangele, as well as the appeal of Fr Christian Buenafe et. al. against Marcos.
The petitioners may still appeal before the Supreme Court.
The remaining appeal was filed by a group led by Margarita Salonga Salandanan.
