5 cops meted life in prison for kidnapping OFW in 2016

FIVE policemen, including a captain, were convicted and sentenced to reclusion perpetua by the Cagayan de Oro City Regional Trial Court yesterday in connection with a 2016 kidnapping case.

Convicted by Cagayan de Oro RTC Branch 17 Judge Ana Candida Casino for the October 23, 2016 kidnapping of Enrique “Eking” Fernandez III were Capt. Ereneo Ramirez, S/Sgt. Jojo Lim, Sgt. Alaindelon Tacubao and Privates First Class Alejandro Ubanan and Sangkula Hussein II.

“The Court finds the accused… guilty beyond reasonable doubt of kidnapping defined and penalized in Article 267 of the Revised Penal Code, as amended by Republic Act 7659, and sentences each accused the penalty of reclusion perpetua,” part of the 27-page decision said.

The court also ordered them to pay jointly and severally the heirs of Fernandez P100,000 in civil indemnity, P100,000 in moral damages, P100,000 in exemplary damages and P50,000 temperate damages as well as the cost of suit.

“All the  amounts due shall earn a legal interest of six percent per annum from the date of the finality of the decision until full satisfaction,” the court added.

The court said their period of detention at the City Jail in Lumbia, Cagayan de Oro City and the Misamis Oriental Provincial Jail shall be credited in full in the service of their sentence.
