THE Office of the Court Administrator yesterday ordered a Cabanatuan judge to explain why he issued a subpoena to traffic enforcers who issued him an illegal parking ticket in Baguio City.
Supreme Court spokesman Brian Keith Hosaka said the OCA directed Cabanatuan Municipal Trial Court Branch 3 Judge Nelson Lago to explain why he should not be cited for indirect contempt after he reportedly issued a subpoena to Bernard Batnag of the Public Order and Safety Division who handed him a ticket for illegal parking during in Baguio City last October 25 while he was attending a security seminar.
Batnag was directed to appear at Lago’s sala on November 29.
The subpoena was directed at Batnag, the traffic enforcement chief assigned at the Baguio City Public Market, and the traffic enforcers who also removed the lucense plate of Lago’s vehicle
“I was told by Court Administrator Midas Marquez that he has requested Deputy Court Administrator for Luzon, Raul B. Villanueva, to ask Judge Nelson Lago to comment on these news reports,” Hosaka told reporters.
The OCA is mandated by law to supervise all courts, its judges and personnel nationwide.
In his subpoena, Lago said settling the fine and recovering his license plate resulted to delays in scheduled hearings and administration of justice of his sala. He also removing his vehicle’s license plate was a violation of due process.
