On the February 16 episode of “CIA with BA,” Senator Alan Peter Cayetano offered advice to an overseas Filipino worker (OFW) wife named Rachel, who sought guidance on how to manage her husband’s gambling addiction.
Cayetano addressed the legal implications of a spouse’s gambling issues, explaining that if the addiction existed before or during the marriage, psychological incapacity could be grounds for annulment. However, if annulment is not the preferred course of action, there are legal protections available to safeguard assets.
The senator clarified that under Philippine law, debts resulting from gambling cannot be charged to a spouse. “Ang maganda po, nasa batas [natin] na ‘yung utang na nanggagaling sa sugal o game of chance ay hindi pwedeng i-charge sa ‘yo,” Cayetano explained. However, he cautioned that there is a risk if joint savings, properties, or assets are used or sold without the knowledge of the other spouse.
Cayetano emphasized three key steps for dealing with a spouse’s gambling addiction. First, he advised acknowledging the problem, stating, “Kailangan ma-realize ng asawa mo na meron siyang addiction.” Second, he recommended seeking help, saying, “‘Pag naamin niya na may problema, get help. Kung kaya niyang tumigil mag-isa, na ‘wag nang [lumapit] sa mga nagsusugal, maso-solusyonan ‘to kaagad. Pero kung hindi, get professional help.” Lastly, he suggested controlling finances, explaining, “Kung alam mong isusugal niya lang ‘yung pera, ‘wag mo nang ibigay sa kanya. Ikaw muna mag-manage nung pera habang may problema siya sa sugal.”
The senator advised the wife to be cautious with their finances and take measures to protect their assets.
