RCAs slap stricter penalties

The Metropolitan Waterworks and Sewerage System-Regulatory Office (MWSS-RO) yesterday said with the effectivity of revised concession agreements (RCAs), it can now slap stricter penalties and bigger fines against erring water concessionaires.

“At present, it only takes three days. After three days, they can already be slapped with penalties based on number of days that they are in violation of their service obligations. We are preparing the IRR (implementing rules and regulations) which will be their guiding rules on how this would be implemented. We will have a public consultation this coming Wednesday,” Patrick Ty, MWSS-RO chief regulator, told reporters in an interview yesterday.

Ty said prior to the implementation of the RCAs, concessionaires can only be penalized after 15 days of violating their service obligations.

MWSS-RO added under the RCA, apart from violation of service obligations, failure to meet target non-revenue water (NRW) for a year may also be penalized. -Jed Macapagal
