ECOP bucks add’l leaves for workers

Employers are opposed to proposals that grant additional leaves to workers saying the reduced number of working days would hurt productivity, add to their cost and encroach on the right of companies to exercise their prerogative.

The Employers Confederation of the Philippines (ECOP) are reacting to 10 Senate bills proposing new employee leaves and / or increasing existing ones which would be heard today, January 24, by the Senate Committee on Labor.

 “Any further reduction in the number of working days through additional leaves would have a critical impact not only on productivity but also on cost of doing business,” the group said in the position paper submitted to Joel Villanueva, chairman of the committee.

The group said any additional non-working days mean days off from work.

“Excessive non-working days would hamper operations and production especially for the manufacturing and service sectors,” ECOP said.

As it, aside from non-working national regular as well as special holidays, there are also other days off from work such as the paid leave benefits that a company may provide to its employees. There are also those cancelled or suspended workdays brought about by calamities.

An employer who requires its workers to report to work on the supposed non-working days, is obliged to pay his worker full pay for the day/s not worked. The employer would also be obliged to pay an additional 30 percent of the daily rate of 100 per cent for the first eight hours of work.

“We are greatly concerned that any further reduction in the number of working days particularly through additional leaves impacts not only on productivity and on the cost of doing business, but also on the viability of micro and small enterprises which constitute over 99 per cent of all registered enterprises,” ECOP said

All the bills prescribing new paid leaves or increasing existing ones make no distinction with regard to the size of establishments, whether micro, small, medium or large, except for the service incentive leave which based on an existing law excludes micro establishments.

That same law also grants the secretary of the Department of Labor and Employment the power to exempt establishments from coverage after considering the viability or financial condition of such establishments.

“The grant of paid leaves is an exercise of management prerogative; nevertheless, the State in the exercise of police power may mandate such grant based on specific contingencies through legislative measures,” ECOP said.. 

SB  360 in particular provides that in addition to leave privileges under existing law, a parental care leave of at least two working days every year for each minor child under their care shall be granted to any employed parent of legal guardian who has rendered services for at least year. 

SB nos. 362 and 398  meanwhile grants women who are employed in the private sector or in public service to one-day paid pre-natal leave every month from filing of notice of such pregnancy until delivery, abortion or miscarriage subject to the following conditions. 

SB 854   mandates an employer to grant the employee a paid school visitations leave of up to three days during any school year which may be taken on any school day to attend school conferences or class room activities related to the employee’s child if the conference or classroom activities cannot be scheduled during non-work hours. 

SB  963, 1063, 1064 and 1209 seek to amend Republic Act 8187, “The paternity leave act of 1996” by increasing the paternity leave of all men in the private and public sector whose spouse had given birth from four days to either 15 days or 30 from the first four to all  deliveries. 

SB 1209 meanwhile prescribes that every married employee, regardless of the nature of employment, whether regular, permanent, contractual, temporary or casual, shall be entitled paternity leave with full pay for the first four deliveries. 

SB  1614 ll seeks to amend Article 95 of the labor code by increasing the service incentive leave of every employee who has rendered at least one year of services. 

SB  1387  prescribes that every legitimate spouse-employee of an overseas worker in the private and public sectors shall be entitled to an overseas worker’s spouse leave of 15 days a year with full pay.
